Mr.Braj Kishore Pd.(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 13-02-2020 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Petitioner apprehends her arrest in connection with Gogri P.S. Case No.371 of 2019, G.R. No.3189 of 2019, registered for the offence punishable under Sections 147, 149, 341, 323, 307, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. The allegation against the petitioner is that petitioner along with other co-accused persons assaulted the informant by means of lathi and danda. The further allegation against the petitioner is that she snatched the mobile phone of the informant. Mr. Binod Kumar, learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case due to previous enmity inasmuch the brother-in-law of the petitioner lodged an FIR against the informant and others bearing SC/ST P.S. Case No.22 of 2019 and the present case has been filed

Patna High Court CR. MISC. No.85658 of 2019(2) dt.13-02-2020 2/2 in retaliation of the same. Learned counsel further submits that both the parties are co-villagers. Learned counsel relying upon Annexure-2 series submits that injuries caused to the persons have been found to be simple in nature. Learned counsel further submits that the petitioner is a lady Government teacher. After having heard learned counsel for the parties and taking into consideration the fact that both the parties are covillagers and there is previous dispute between the parties and the petitioner is Government servant and working as a teacher, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by her, she shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Gogri P.S. Case No.371 of 2019, G.R. No.3189 of 2019, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
