2. The petitioner has prayed for bail in connection with Giriyak P.S. Case No. 395 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 118(2), 117(2), 109(2), 352, 351(2), 3(5) of the B.N.S., 2023.

3. The case of the prosecution in short is that the petitioner has assaulted with bamboo on the head of the informant due to which he fell down. It is further alleged that after that the son of the informant arrived who were armed with knife.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

Learned counsel for the petitioner submits that the allegation against the petitioner is that he has assaulted on the head of the informant. The injury of the informant is simple in nature. He also submits that Kundan Kumar and Chandan Kumar who has already been granted bail by the learned coordinate bench of this court passed in Cr. Misc. No. 90623 of 2025. The case of this petitioner stands on better footing. He further submits that there is also a case and counter case between the parties and the occurrence has taken place on trivial issue of grazing of grass by cattle. He further submits that the petitioner is languishing in judicial custody since 10.09.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda in connection with Giriyak P.S.
