The petitioner is in custody in connection with Kanti P.S. Case No. 337 of 2019 for the offence under Sections 25(1b)a, 26 and 35 of the Arms Act and Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal history and he is in custody since 10.05.2019.

It is alleged that on search, three country made pistols with 6 magazines and 24 live cartridges and 41.760 litres of foreign liquor were recovered from the house of the petitioner and not from his conscious possession.

No.82492 of 2019(3) dt.18-03-2020 2/2 Considering the fact that the petitioner has got no criminal antecedent and he is in custody for more than ten months, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Kanti P.S. Case No. 337 of 2019.
