JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 Petitioner seeks regular bail in connection with Amarpur (Fullidumar) P.S. Case No. 537 of 2018 registered for the offence punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

Allegation as per F.I.R. is that petitioner assaulted the informant by axe causing injury on his head.

Submission of the learned counsel for the petitioner is that there is a land dispute between the parties and there is no allegation of repetition of blow against the petitioner. He is in custody for about 4 months, having no criminal antecedent. Heard learned A.P.P. who has opposed the prayer for bail on the ground that injury is serious in nature. Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named,

Patna High Court CR. MISC. No.7527 of 2020(3) dt.18-02-2020 2/2 be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Banka, in connection with Amarpur (Fullidumar) P.S. Case No. 537 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
