The petitioner is in custody since 24.08.2019 in connection with Brahmpura P.S. Case No. 280 of 2019 for the offences under Sections 379, 411, 412 and 414 of the Indian Penal Code.
The allegation against the petitioner is that he was involved in a case of theft of a pick-up van. Learned counsel for the petitioner submits that as per the prosecution case, two persons from Pick-up van and two persons from Swift Dzire, on seeing the police party, started fleeing away whereas three persons including the petitioner was apprehended on the spot. Learned counsel submits that the very narration of the case written by the police creates doubt that the

Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10, 000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahmpura P.S. Case No. 280 of 2019.
