JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Pupri P. S. Case No. 300 of 2019, disclosing offences under Sections 272& 273 of IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

While the police was on patrolling, two persons were coming by motorcycle, on seeing the police party, they have fled away from the spot and Chowkidar, who has identified that out of fleeing persons, one is of petitioner and there is recovery of 43.200 liters of Nepali Saufi Wine. The name of the Chowkidar is also mentioned in the F.I.R.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case, having no criminal antecedent.

Heard learned A.P.P. also.

Patna High Court CR. MISC. No.83425 of 2019(2) dt.21-01-2020 2/2 Having heard both sides, in view of the submissions, made above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.
