Petitioner seeks bail in Routa P.S. Case No. 46 of 2018 instituted for the offence under Section(s) 304(B), 201, 302, 120-B is pending in the court of Chief Judicial Magistrate, Purnea.
Petitioner is husband of the deceased.
In the written report, it is alleged that daughter of the informant was married with the petitioner five years ago. On 06.05.2018 at 2.00 AM, husband of the deceased informed the informant that his daughter is traceless. The informant and his family members reached the matrimonial house of his daughter and started searching his daughter. During course of search, informant and his family members reached at the bank of
Patna High Court Cr.Misc. No.72594 of 2018(3) dt.19-12-2018 2/2 Kankai river and saw that several dogs have assembled in the bank of river. The informant and his family members went there and saw dead body of his daughter hidden beneath sand of river. It is alleged that all the accused persons including this petitioner have committed murder of his daughter and hide her dead body beneath the sand in the river. It is alleged that love affair was going on between this petitioner and Javi Parveen. Case diary has been received. Learned APP has submitted that dead body has been recovered from the bank of river hidden beneath sand. Doctor has opined cause of death as asphyxia.
This petitioner himself informed the informant that his daughter is missing and thereafter dead body was recovered from the bank of river hidden beneath sand.
In the facts and circumstances of the case, this Court does not find it a fit case for grant of bail. Prayer of the petitioner for grant of bail is rejected at this stage.
