The petitioner seeks bail in connection with Bajpatti P.S. Case No. 387 of 2019 dated 08.11.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

From the FIR it appears that 147 litres of Nepali liquor was recovered from the tempo which was being driven by the petitioner.

It has been submitted on behalf of the petitioner that it is a case of mistaken identity and the petitioner owns the tempo vehicle which he plies on the road commercially for earning his livelihood. It has further been submitted that he has been made accused unnecessarily.

Considering the aforesaid facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Bajpatti P.S.
