JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 Petitioner prays for bail in connection with Basnahi P.S.Case No. 79 of 2018 registered for the offences punishable under Sections 147, 148, 149, 307, 302, 385 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per FIR is that there was demand of extortion by the accused persons from father of the informant and there is also allegation against them of assaulting father of the informant and also there is specific allegation of firing against other accused and it is stated that people assembled and they were apprehended.
Submission of learned counsel for the petitioner is that there is no allegation either of assault or firing against the petitioner and he is in custody for more than four months. Heard learned APP also.

No.71883 of 2018(2) dt.07-12-2018 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Saharsa, in connection with Basnahi P.S.Case No. 79 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
