The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 365/34 of the Indian Penal Code.

The prosecution case as per the written report of Lalita Devi dated 13.09.2017 submitted to the Station House Officer of Ayer Police Station is to the effect that on 11.09.2017 at 5.30 P.M. the husband of the informant went to attend a feast with his close friend, Vikash Kumar. When he did not return till late night then the informant inquired from her father-in-law, who conveyed that her husband had gone towards the poultry farm along with Vikash Kumar Singh and three other persons

It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled. There is no direct evidence collected during investigation against the petitioner. It is further submitted that for the occurrence of 11.09.2017, the FIR has been registered on 13.09.2017. Moreover, co-accused Ramesh Kumar has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 60688 of 2017. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the petitioner is named in the First Information Report.

Considering the circumstantial nature of acusation coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bhojpur at Ara in connection with Ayer
