JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 The petitioner seeks regular bail in connection with Chandauti P.S. Case No. 252 of 2018, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case is that the police while patrolling received secret information that illegal business of liquor was going on in the forest at the bank of river Jamuna and for verification of the said information, police proceeded for the said place and on seeing the police, some persons started fleeing away, however, one of them was caught and he disclosed the name of petitioner and others and there was recovery of 30 litres of mahua liquor.

No.958 of 2020(2) dt.16-01-2020 2/2 It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from the possession of the petitioner. Further he has no criminal antecedent and has been in judicial custody since 03.12.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Chandauti P.S. Case No. 252 of 2018.
