2. Petitioner seeks regular bail in connection with Danapur P. S. Case No. 1200 of 2024 in a case registered for the offences punishable under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per prosecution case, F.I.R. named accused persons along with 4-5 unknown persons, under conspiracy, fired shots on the informant's father, causing his death.
4. Learned counsel for the petitioner submits that informant is not an eye witness of the occurrence and petitioner has been made accused in this case only on the basis of confessional statement of co-accused Kundan Kumar who has already been granted regular bail by court vide order dated
Patna High Court CR. MISC. No.90087 of 2025(2) dt.12-02-2026 2/2 20.11.2025 passed in Cr. Misc. No. 20068 of 2025. Petitioner claims clean antecedent and he is in custody since 12.12.2024.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Danapur P.
