The petitioner seeks regular bail in connection with Chandauti PS case no. 252 of 2018 instituted for the offences punishable under Section 30(a) of Bihar Prohibition & Excise Act, 2016.

The allegation is regarding recovery of 30 liters of mahua liquor from the bank of the river in question and the co-accused persons are said to have named the petitioner as being their accomplice.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 03.12.2019.

No.86726 of 2019(2) dt.16-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent and no recovery of illicit liquor has been made from the conscious possession of the petitioner herein, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Chandauti PS case no. 252 of 2018.
