2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126 (2), 115 (2), 118 (1), 109, 303 (2), 352, 351 (2) and 3 (5) of the BNS.

3. The case of the prosecution is that the petitioner ordered the co-accused persons to sprinkle petrol on a JCB machine and set it on fire, however, no such incident took place and no JCB was actually set on fire. It is further alleged that petitioner took Rs. 2000/- from the pocket of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that due

No.89532 of 2025(2) dt.27-01-2026 2/2 to dispute between the petitioner and the owner of the JCB, this case has been filed with male fide intention to harasss the petitioner. It is further submitted that the only allegation against the petitioner is that he gave an order to sprinkle petrol on the JCB which order was never acted upon. Moreover, the petitioner is languishing in judicial custody since 26.09.2025. 5.

Learned APP appearing for the state has vehemently opposed the prayer of regular bail stating that the petitioner has three criminal antecedents

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bheja P.S. Case No. 66 Of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Jhanjharpur, Madhubani.
