Petitioner seeks bail in Chapra Town P.S. Case No.582 of 2018 instituted for the offence under Section(s) 413, 414/34 Indian Penal Code.

Counsel for the petitioner submits that there is no recovery of motorcycle from possession of the petitioner. In the written report, it is alleged that police apprehended one Sumant Kumar, who disclosed name of Manoranjan Ray, who had fled away. It is further alleged that Manoranjan Ray disclosed name of other associates, namely, Sonu Kumar Singh @ Gandhi, Monu Kumar Singh, Dhiraj Kumar, Anish Kumar Yadav and Neeraj Pandey. It is further alleged that the police after recording confessional statement of

Patna High Court Cr.Misc. No.72584 of 2018(2) dt.06-12-2018 2/2 Sumant Kumar and Manoranjan Rai, arrested this petitioner and others. On the basis of statement of Manoranjan Rai, two motorcycles have been recovered from Ekma stand. Petitioner is in custody since 28.09.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S. Case No.582 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
