JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 By way of present modification application, the petitioner seeks to modify the order dated 30.08.2018 passed in Cr. Misc. No. 49842 of 2018, by which, the petitioner was granted anticipatory bail.

It has been submitted by learned counsel for the petitioner that vide order dated 30.08.2018, the petitioner was granted anticitparoy bail and was directed to surrender before the court below for furnishing bail bonds, however, as she fell ill, she could not surrender in the court below within the time prescribed in the order dated 30.08.2018 and seeks further two weeks' time to surrender in the court below.

Heard learned A.P.P. also.

Considering the facts and circumstances, I am not

Patna High Court Cr.Misc. No.70418 of 2018(2) dt.12-12-2018 2/2 inclined to modify the order dated 30.08.2018, however, the petitioner, if so desire, may surrender before the court below and pray for regular bail and if any such application is filed, the court below after considering the fact that the petitioner was earlier granted anticipatory bail, shall dispose of the application of the petitioner, if possible, on same day, without being prejudiced by this order.

With the above observation, this application is disposed of.
