The petitioner is apprehending his arrest in connection with Dhansoi P.S. Case No. 89 of 2018 for the offence under Section 272, 273 of the Indian Penal Code and Section 30 (a) / 35/38 of Bihar Prohibition and Excise Act 2016. Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He further submits that only the fact that petitioner is owner of the tractor which was intercepted by the police in connection with illegal trade of liquor. There is no other material against petitioner. Considering the fact that the petitioner has no criminal antecedent and he is only owner of the vehicle and not directly involved in the business of liquor, let the petitioner above
Patna High Court Cr.Misc. No.75529 of 2018(2) dt.19-12-2018 2/2 named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Additional District & Sessions Judge-II - cum-Special Judge, Excise, Buxar, in connection with Dhansoi P.S. Case No. 89 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C. As also the condition that in future the vehicle of the petitioner is found involve in such activities in future, the bail of the petitioner in the instant case will be cancelled by the Court below.
