The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner, who is in custody in connection with Baligaon P.S. Case No. 159 of 2024, lodged on 19.11.2024, giving rise to S.T. No. 401 of 2025, under Sections 310(2)/317(3) of the B.N.S. 2023.

3. Learned Counsel for the petitioner submits that earlier prayer for bail of the petitioner was rejected vide order dated 03.06.2025 passed in Cr. Misc. No.34332 of 2025 by this Court. He submits that bail application was rejected with liberty to renew his prayer for bail three months after framing of the

Patna High Court CR. MISC. No.89315 of 2025(2) dt.19-12-2025 2/2 charge. Counsel submits that it is specific plea that charge has been framed on 18.08.2025 and bail application has been filed after three months of framing of the charge.

4. Learned Counsel for the State opposes the prayer for bail but submits that in the bail application the other coaccused have also been granted bail vide Annexures-P/3 and P/4.

5. In the present facts and circumstances of this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned Additional Sessions Judge-IX, Vaishali at Hajipur, in connection with Baligaon P.S. Case No.159/2024 (S.T. No.401 of 2025), subject to the conditions as laid down U/s 480(3) of the BNSS, 2023.
