The petitioner seeks regular bail in connection with Giriyak P.S.Case No.345 of 2019 registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 302 and 506 of the Indian Penal Code.

On the order of the petitioner, one Ram Sharan Yadav assaulted by lathi to the deceased thereafter there is general allegation of assault against all the accused persons of assaulting the deceased. Para 3 of the petition shows that the petitioner is accused in three other cases.

Submission of the learned counsel for the petitioner is that even according to the FIR he is order giver and no specific allegation has been attributed. There is general and omnibus allegation against the petitioner . He is in custody for two months.

Heard learned A.P.P. as well as the learned counsel for the informant, who has opposed the prayer for bail on the ground

No.84297 of 2019(3) dt.13-01-2020 2/2 that the petitioner is accused in 31 cases, which appears from para 7 of the case diary and the learned counsel for the petitioner has again submitted that he has filed supplementary affidavit stating that such statement in the case diary is wrong rather he has been acquitted in all the other cases.. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Ist, Nalanda at Biharsharif in connection with Giriyak P.S.Case No.345 of 2019 . However, it is made clear that if the statement of the petitioner is found false, the learned court below apart from cancelling the bail bond of the petitioner, shall take steps for proceeding against the petitioner with regard to swearing false affidavit.. With the above direction, this application is allowed.
