2. The petitioner apprehends his arrest in connection with Jehanabad Excise P.S Case No. 494 of 2025 registered for the offences punishable under Sections 30(a) of Bihar Prohibition & Excise Amendment Act, 2016.

3. As per the prosecution case, total six litres of illicit liquor were recovered from the bag.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that petitioner has got one criminal antecedent as stated in para 3 of the bail petition.

5. Learned counsel for the State opposes the prayer for bail of the petitioner.

6. From perusal of the F.I.R., impugned order and materials available on record it appears that petitioner is not arrested on the spot and there is no recovery was made from the conscious possession of the petitioner.

7. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise-I, Jehanabad in connection with Jehanabad Excise P.S Case No. 494 of 2025 subject to the condition laid down under Section 482(2) of B.N.S.S and also with further condition that concerned police station shall verify the present and current address of the petitioner and petitioner shall reside within the jurisdiction of the concerned trial Court till conclusion of the investigation.
