Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 28.8.2018 passed in Cr. Misc. No.49333 of 2018 with a direction to surrender within a a period of six weeks.

Submission of the learned counsel for the petitioner is that there is no allegation that he has not taken money but conditional bail has been granted with direction to deposit the same. In such view of the matter, two weeks time is allowed to the petitioner to surrender.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.71589 of 2018(2) dt.12-12-2018 2/2 circumstances, as stated above, this modification application is allowed with condition that if the petitioner surrenders within a period of two weeks from the date of receipt of the order, the learned trial court shall release him on anticipatory bail, as per the condition mentioned in order dated 28.8.2018 passed in Cr. Misc. No.49333 of 2018.

With the aforesaid observation, this application is allowed.
