2. Petitioner is seeking bail in connection with Janta Bazar P.S. Case No. 271 of 2025 dated 04.11.2025 registered for the offences under Section 30(a) of Bihar Prohibition and Excise Amendment Act.

3. As per FIR, 500 ml. water bottle filled with yellow drink, which was smelling like liquor.

4. Learned counsel for the petitioner submits that petitioner is said to be a driver of the commercial vehicle fromwhere the recovery is said to have been made. It is next submitted that the passenger, who was sitting in the said pick-up van, was in possession of the seized liquor, which has kept beneath the seat and was also apprehended by the police. It is submitted that merely because of the said seizure, the petitioner,

Patna High Court CR. MISC. No.89264 of 2025(2) dt.24-12-2025 2/2 who was driving the vehicle, was also taken in judicial custody and remained in custody since 05.11.2025. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP for the State vehemently opposed the prayer for bail.

6. Regard being had to the submission made by the parties and taking into consideration the period of custody of the petitioner, this Court is inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 03, Saran at Chapra in connection with Janta Bazar P.S. Case No. 271 of 2025.
