====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mahila P.S. Case No. 126 of 2018, instituted for the offence under Sections 420, 509, 354 and 376 of the Indian Penal Code.
Counsel for the petitioner submits that informant herself has given a petition prior to the instant First Information Report before the Sr. Superintendent of Police, Patna, making allegation that teacher Kumar Gaurav sexually harassed her for 8 years on the assurance of performing marriage with her. Counsel for the petitioner further submits that informant has prepared voter identity card in the name of Kajal Kapoor. She has given her resume before Saija Micro Finance Company as Komal Kumari and when petitioner who was also employee of the aforesaid company came to know about all these facts and about bad character of the informant, she gave her resignation which was accepted by the petitioner.
Patna High Court Cr.Misc. No.73467 of 2018(3) dt.09-01-2019 2/2 Thereafter, the instant case has been filed. The photocopy of Identity card, resume of Kajal Kumari and resignation letter filed on behalf of Kajal Kumari as well as relieving letter have been enclosed as Annexure-3 series. The informant has also filed earlier complaint against teacher Kumar Gaurav before the Sr. Superintendent of Police, Patna.
Petitioner is in custody since 3.9.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Priya Shekhar, learned Judicial Magistrate, 1st Class, Patna, in connection with Mahila P.S. Case No. 126 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
