Petitioner seeks bail in Magadh Medical P.S. Case No. 185 of 2018 registered for the offence punishable under Section 414 of the Indian Penal Code and Section 25(1-b), 26 and 35 of the Arms Act.
Allegation against the petitioner is of recovery of 20 rounds of 315 live cartridges and one country made pistol. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since 30.07.2018.
However, considering the fact that huge amount of arms and ammunition have been recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on bail
Patna High Court Cr.Misc. No.74239 of 2018(2) dt.14-12-2018 2/2 at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.
However, petitioner is granted liberty to renew his prayer for bail after completing one year of Jail custody. (S. Kumar, J) ranjan/- U
