Petitioners apprehend arrest in a case registered for offence under section 307 and other allied sections of the Indian Penal Code.
It is submitted on behalf of the petitioners that there is a case and counter case between the parties. Occurrence has occurred due to some land dispute and the petitioners' side has also sustained injuries which have been opined to be grievous in nature. Injury report of petitioner no. 3, 4 and 5 has been annexed to the instant bail petition. Prior to the instant case,
Patna High Court Cr.Misc. No.75049 of 2018(2) dt.20-12-2018 2/2 there is no criminal antecedent of the petitioners. Considering the aforesaid submissions and the facts and circumstances of the case, prayer for bail to all the ten petitioners is allowed. In the event of arrest/surrender within four weeks from today, Let the petitioners as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, V, Madhepura in Srinagar Police Station Case No. 56 of 2016 on the following conditions:- One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and The Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
