JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 Petitioner apprehends his arrest in connection with Warisaliganj P.S.Case No. 195 of 2018 registered for the offences punishable under Sections 498A, 323 and 379/34 of the Indian Penal Code.
Allegation against the petitioner is of assault to his wife-informant, causing injuries to her and also she has been removed from his house.
Submission of learned counsel for the petitioner is that he is working at Calcutta, whereas informant is working at Hariyana and due to petty dispute the present case has been lodged and further petitioner is ready to keep his wife with full dignity.
Heard learned APP and learned counsel for the
Patna High Court Cr.Misc. No.77810 of 2018(2) dt.03-01-2019 2/2 informant, who has stated that informant is ready to live with the petitioner if petitioner keeps her with full dignity. Having heard both sides and in the facts and circumstances, this application is disposed of with direction to petitioner to surrender in the court below on 11.2.2019 when informant shall also be present in court and the learned court below will make efforts to re-conciliate between the parties and if there is no fault found on the part of the petitioner, learned court below will release the petitioner on bail to its own satisfaction, otherwise learned court may pass any other order(s).
