Mr. Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 Petitioner prays for bail in connection with Arwal P.S.Case No. 244 of 2018 registered for the offence punishable under Section 366A of the Indian Penal Code.
Allegation as per FIR is that while petitioner fleeing away with minor girl of the informant they were apprehended by the villagers and handed over to police.
Submission of learned counsel for the petitioner is that in her statement under Section 164 Cr.P.C. the victim girl has stated that she was going along with the petitioner and they were arrested and she has no made any other overt act against the petitioner and he is in custody for more than three months. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.73855 of 2018(2) dt.17-12-2018 2/2 circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal, in connection with Arwal P.S.Case No. 244 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
