2. The petitioner seeks regular bail in connection with Sessions Trial No. 825 of 2025 arising out of Bodhi Bigha P.S. Case No. 76 of 2024 lodged on 26.11.2024, for the offence punishable under Section 103 of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of District & Additional Sessions Judge-III, Sherghati, Gaya.
3. Learned Senior counsel for the petitioner submits that the regular bail application of the petitioner was earlier rejected vide order dated 05.06.2025 passed in Cr. Misc. No. 35431 of 2025. Senior counsel submits that the name of the
Patna High Court CR. MISC. No.90111 of 2025(3) dt.25-02-2026 2/3 petitioner has come in this case only on the ground of strong suspicion. Senior counsel further submits that charge has already been framed in this case and the petitioner is in custody since 30.12.2024, having clean antecedent. Senior counsel submits that no purpose would be solved keeping the petitioner into custody. Senior counsel submits that on earlier occasion, report with regard to the present stage of the trial was called for.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that in the FIR, it has come that the informant' mother was sleeping with her grand daughter (natini) but, in the next morning, neck of the informants' mother was cut and dead body was found. Counsel also submits that in the earlier rejection order dated 05.06.2025, it has come that the weapon used in the crime was recovered and there is not only suspicion, rather, corroboration is also there.
5. From the report, it transpires that the charge has already been framed, but the prosecution has not produce any witnesses till date. The trial is currently at the stage of prosecution evidence. It has also been stated in the report that there is every likelyhood for conclusion of trial within nine months.
6. In this view of the matter, this Court is not inclined
Patna High Court CR. MISC. No.90111 of 2025(3) dt.25-02-2026 3/3 to grant bail to the petitioner at this stage. Accordingly, the prayer for regular bail of the petitioner is hereby rejected at this stage.
