JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Mahila P.S.Case No. 44 of 2018 registered under Sections 323, 341, 366A , 498A and 504/34 of the Indian penal Code. Allegation against the petitioner is that he had taken the informant and married with her and made physical relationship with her. It is alleged that petitioner and his family members denied to keep her in their house unless demand of Rs. 3 lacs and a motorcycle is not fulfilled.

Submission of learned counsel for the petitioner is that informant is the sister-in-law of the cousin of the petitioner and in order to pressure him to marry her, present case has been lodged as no such occurrence has taken place and petitioner is in custody since 04.09.2018.

Patna High Court Cr.Misc. No.74841 of 2018(2) dt.20-12-2018 2/2 Heard learned APP and learned counsel for the informant who have opposed the prayer of bail stating that petitioner has married her and having made physical relationship also and is not ready to keep her.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Rohtas at Sasaram in connection with Mahila P.S. Case No. 44 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
