JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2019 The petitioner seeks bail in connection with Warsaliganj P.S. Case No. 318 of 2019 which has been instituted for the offences under Sections 399, 402 of the Indian Penal Code and Section 25(1-B) a, 26, 35 of the Arms Act.

On suspicion that petitioner and other accused persons are planning to commit dacoity, they were apprehended and from the possession of the petitioner, it appears that three mobile telephones were recovered, out of which, two were not functional but belonged to the petitioner. The petitioner is in custody since 25.09.2019. There is another case against the petitioner but in the aforesaid case also, he has not been named in the F.I.R. One of the co-accused persons from whom one mobile telephone has been recovered, has been granted bail by a Bench of this Court vide order dated 04.12.2019 passed in Cr. Misc. No. 79036 of 2019.

Considering the aforestated facts, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Nawadah in connection with Warsaliganj P.S. Case No. 318 of 2019.
