Petitioner apprehends his arrest in a case registered under Sections 341, 323, 325, 452, 504, 506, 379, 307/34 of the Indian Penal Code.

Allegation against petitioner is that he alongwith other accused persons assaulted the informant and his family members by lathi, danda and Khanti, causing injury on the head of informant.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. There is single forehead injury found on person of informant which is simple in nature whereas the allegation of assault is

Patna High Court CR. MISC. No.85572 of 2019(2) dt.14-02-2020 2/2 by eight accused persons. Similarly placed co-accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court as contained in Annexure-4. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Govindpur P.S. Case No. 90 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
