The petitioners are apprehending their arrest in connection with Sadar (Mabbi Darbhanga) P.S.Case no.55 of 2018 , registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code.
A dead body was found lying in the field of Usman Khan and later on the same was identified and the name of the petitioners transpired during the investigation of the case. Submission of the learned counsel for the petitioners is that only on the basis of suspicion the petitioners have been made party and they are ladies and the mother of the deceased has also filed a petition that the petitioners have no hand in that. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.78426 of 2018(3) dt.11-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Darbhanga in connection with Sadar (Mabbi Darbhanga) P.S.Case no.55 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation otherwise the bail bond shall be caonsidered. With the aforesaid observation, this application is allowed.
