The petitioner seeks pre-arrest bail in connection with Bihpur (Bhawanipur) P.S. Case No. 304 of 2019, registered under Sections 467, 468, 471, 420, 120B, 110 and 114 of the Indian Penal Code.

The accusation is that Balram Singh, father of Diwakar Kumar Singh, the informant, had performed two marriages. From first wife, Sita Devi, there is one male child. After the death of Sita Devi, Balram Singh performed marriage with Uma Devi, with whom he blessed with two sons, Diwakar Kumar Singh (informant) and Prabhakar Kumar Singh. At the time of marriage of his father with his mother, Uma Devi, Uma Devi come with a male issue, Shailendra Kumar Singh and female issue, Neelam Devi. After death of Balram Singh,

No.83459 of 2019(2) dt.10-01-2020 2/3 Shailendra Kumar Singh got his name entered in jamabandi by preparing the forged pedigree in collusion with Sarpanch, Amrendra Yadav @ Bablu Saheb (petitioner) from Circle Office, Narayanpur, in respect to land of informant Diwakar Kumar Singh and his brother and Shailendra Kumar Singh sold the said land to different person.

Learned counsel appearing on behalf of the petitioner submits that the allegation is about getting entered his name by Shailendra Kumar Singh with respect to the land of informant and his brother in Circle Office, Narayanpur, on the basis of the forged pedigree, in collusion with Sarpanch (petitioner). The petitioner, being the Sarpanch, had no role in that regard, but, with ulterior motive and dirty village politics the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Bihpur (Bhawanipur) P.S. Case No. 304 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial
