The petitioner has been in custody since 02.11.2018 in connection with Nadi P.S. Case No. 227/2018 registered for the offense punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner, but had been found lying near the railway track. It is further submitted that the petitioner has no criminal antecedent.
In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand)
Patna High Court Cr.Misc. No.76913 of 2018(2) dt.10-01-2019 2/2 with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Nadi P.S. Case No. 227 of 2018.
