The petitioner in the present case is seeking regular bail in connection with Special Case No. 77 of 2019 arising out of Patrakar Nagar P.S. Case No. 531 of 2019 registered under Sections 20/22/24 of N.D.P.S. Act, pending in the court of learned Additional District Judge - XVII, Patna. Learned counsel for the petitioner submits that only nine puriya of brown sugar is said to have been recovered from the possession of the petitioner but there no weight was taken and the quantity was never measured, and co-accused Karu Kumar @ Ravi Kumar @ Ravi has been granted privilege of regular bail by learned coordinate Bench of this court, however petitioner is in custody since 15.07.2019 having no criminal antecedent.
Patna High Court CR. MISC. No.83273 of 2019(2) dt.07-01-2020 2/3 Learned A.P.P. for the State has opposed the prayer for bail.
Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that as per allegations nine puriya of brown sugar is said to have been recovered from the possession of the petitioner but no weight thereof was taken and the quantity was never measured as also that the co-accused Karu Kumar @ Ravi Kumar @ Ravi from whose possession four puriya of brown sugar has been recovered has been granted regular bail by learned coordinate Bench of this court vide order dated 18.12.2019 passed in Cr. Misc. No. 82098/2019 as also that the petitioner is in custody since 15.07.2019 and the investigation in this case is complete as also petitioner has no criminal antecedent, let the abovenamed petitioner be released on bail furnishing bail bond of Rs.
15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District Judge - XVII, Patna, in connection with Special Case No. 77 of 2019 arising out of Patrakar Nagar P.S. Case No. 531 of 2019, subject to the condition as laid down under Section 437(3) Cr.P.C.
(a) that such person shall attend in accordance with

No.83273 of 2019(2) dt.07-01-2020 3/3 the conditions of the bond executed under this Chapter, (b) that such person shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer or tamper with the evidence.
