JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Bhore P.S.Case No. 263 of 2018 registered under Sections 147, 148, 149, 302, 323, 324, 341, 436 and 504 of the Indian penal Code and 27 of the Arms Act.
Allegation against the petitioner is that he along with other accused persons came and made indiscriminate firing while the informant's brother was playing football in the field. Thereafter his Bhabhi and other ladies went to save him, Lal Bahadur Yadav fired causing injury to Kishanawati Devi and other accused persons assaulted her by Lathi and Danda. The accused persons also assaulted Laxmi Devi and Pujar Kumari with Lathi and Danda causing injuries. In course of treatment Kishnawati Devi died.
Patna High Court Cr.Misc. No.74847 of 2018(2) dt.20-12-2018 2/2 Submission of learned counsel for the petitioner is that of course, petitioner is named int eh FIR but no specific allegation has been attributed against him even it has not been stated with what type of ammunition he has armed with and petitioner is in custody since 24.07.2018.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Bhore P.S. Case No. 263 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
