The petitioner is apprehending his arrest in connection with Daudnagar P.S. Case No. 253 of 2017 for the offence registered under Sections 30 (a) (c) of the Excise Act. Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession and the motorcycle in question has been sold by him in the year 2016 itself. It is further submitted that the petitioner was not arrested from the place of occurrence and one Sanjay Sah had fled away from the place of occurrence after leaving the motorcycle which was sold to him by the petitioner. Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let

No.84316 of 2019(2) dt.19-12-2019 2/2 the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of ADJ - VII cum Special Judge, Excise, Aurangabad in connection with Daudnagar P.S. Case No. 253 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
