JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 334 of 2019 arising out of Sadar P.S. Case No. 80 of 2018 for the offenses under Sections 363/366(A) of the Indian Penal Code.
Allegation against the petitioner is that he was involved in kidnapping of the daughter of the informant. Learned counsel appearing on behalf of the petitioner would submit that statement of the victim girl was recorded under Section 164 Cr.P.C. and from her statement it appears that there is absolutely no any allegation against this petitioner. The petitioner is in custody since 25.08.2019.
Considering the statement of the victim girl under
Patna High Court CR. MISC. No.84671 of 2019(4) dt.04-06-2020 2/2 Section 164 Cr.P.C., the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the 5th Additional Sessions Judge, Purnea in connection with Sessions Trial No. 334 of 2019 arising out of Sadar P.S. Case No. 80 of 2018, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of one month.
