The petitioners are apprehending their arrest in connection with Mufassil P.S.Case nO.68 of 2018 , registered for offences punishable under Sections 323, 325, 379, 452 and 354(B)/34 of the Indian Penal Code.

Allegation against the petitioners and other accused persons is that they entered inside the house of the informant and torn the clothes and also assaulted by lathi. Submission of the learned counsel for the petitioners is that there is land dispute and earlier to lodging of this case a case had been lodged by one of the co-ccused and considering the same this Court had earlier granted privilege of anticipatory

Patna High Court Cr.Misc. No.77700 of 2018(2) dt.02-01-2019 2/2 bail to the co-accused persons vide order dated 29.8.2018 passed in Cr.Misc. No.49699 of 2018 .

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Mufassil P.S.case No.68 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
