The petitioner seeks bail in Suppi PS Case No. 46 of 2019 registered under Section 120B of the IPC and Sections 25(1b)a, 26, 35 of the Arms Act. Some mobile phone and country made pistols were recovered from the house of co-accused Ram Naresh Sah. Petitioner has been implicated as being one of the persons who fled away from the place of recovery.
Counsel for the petitioner submits that prior to the instant case there was no criminal antecedent against the petitioner, though subsequently he has also been made accused in Suppi PS Case No. 101 of 2019. It is submitted that merely because some villagers have stated name of the petitioner on extraneous consideration he has been implicated in the instant case though there is no recovery from him to connect him with the offence. In such circumstances he is in custody since 26.6.2019. Considering the aforesaid submissions the petitioner's prayer for bail is allowed.

No.85141 of 2019(2) dt.16-01-2020 2/2 Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Sitamarhi in Suppi PS Case No. 46 of 2019 on the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. (ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled.
