2. Petitioner is seeking bail in connection with Magadh University P.S. Case No. 245 of 2025 registered for the offences under Section 30(a) of Bihar Prohibition and Excise Amendment Act.

3. As per FIR, 68.875 liters of foreign liquor is said to have been recovered from the orange colour Toto.

4. Learned counsel for the petitioner submits that petitioner, being a driver of the Toto bearing Registration No. BR02RA-5819, from where the recovery is said to have been made, has no knowledge with regard to the seized articles being kept under it and the same does not belong to this petitioner. It has fairly been submitted that the petitioner has one criminal antecedent, which is not akin to the same case. Lastly, it is

5. Learned APP for the State vehemently opposed the prayer for bail.

6. Regard being had to the submission made by the parties and taking into consideration the fact that the petitioner is a driver and has no connection with the seized article and the same was not within his knowledge and is in custody since 31.10.2025, this Court is inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge, Court No.1, Gaya in connection with Magadh University P.S. Case No. 245 of 2025.
