JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sitamarhi P.S. Case No. 935 of 2018 for the offence under Sections 363, 365/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 28.08.2019. He further submits that only on the basis of suspicion, the petitioner has been made accused in this case. He further submits that co-accused Jitendra Kumar has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 32220 of 2019 on 16.11.2019.

Considering the fact that the petitioner has got no criminal antecedent and co-accused has been granted bail, the petitioner, named above, is directed to be released on his

Patna High Court CR. MISC. No.83565 of 2019(4) dt.27-05-2020 2/2 personal bond, due to the circumstance of total lock down on account of pandemic Covid-19, to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 935 of 2018.
