The petitioner seeks bail in Special Case No. 04 of 2013 arising out of CBI/ACB/R.C. Case No. 3(A)/2013 instituted for the offence under Sections 120(B) read with Sections 420, 467, 468, 471, 477A of the Indian Penal Code and Sections 13(2) read with Sections 13(1)(d) of Prevention of Corruption Act, 1988.
As per prosecution report, Gramin Dak Sewaks (GDS) have been appointed in the post offices under the jurisdiction of Superintendent of Post, Sitamarhi, on the basis of fake educational testimonials issued by Bihar Sanskrit Shiksha Board and other institutions, in utter disregard to the laid down rules of the Postal Department during the period
Patna High Court Cr.Misc. No.77010 of 2018(2) dt.20-12-2018 2/2 2008-12.
From the written report it appears that appointment was made in the year 2008-12 and the case has been lodged on 12.3.2013.
Counsel for the petitioner submits that co-accused Uma Shankar Kumar has been granted bail by this Court vide order dated 20.9.2018 passed in Cr.Misc. 55665 of 2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge CBI-II, Patna, in connection with Special Case No. 04 of 2013 arising out of CBI/ACB/R.C. Case No. 3(A)/2013, subject to the condition that both the bailors will be the close relatives of the petitioner.
