JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Parsauni P. S. Case No.73 of 2019, disclosing offences under Sections 302/120B of IPC and Section 27 of the Arms Act.

As per F.I.R. the informant got information of the murder of his father and he came there and he came to know that earlier there was a Panchayat and thief was called and for that, father of the petitioner was present. There was a dispute with respect to handing over the thief and due to not handing over the thief, the deceased was killed.

Submission of the learned counsel for the petitioner is that he has not named in the F.I.R. He has falsely been implicated in this case.

Heard learned A.P.P. as well as learned counsel for the

Patna High Court CR. MISC. No.83105 of 2019(2) dt.21-01-2020 2/2 informant, who has opposed the prayer for anticipatory bail stating that during the investigation it has come on record that alias name of Shailendra Singh is Randheer Kumar Singh, who is petitioner in this case. As such, there is specific allegation against the petitioner.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail.
