JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 15.01.2019 and seeks bail in connection with Darbhanga Sadar P. S. Case No.489 of 2018 registered for the offences punishable under Sections 302, 120B of the I.P.C. and Section 27 of the Arms Act. Petitioner is not named in the first information report and the name of petitioner came in course of investigation in confessional statement of co-accused Neeraj Kumar and other and subsequently, petitioner was arrested and he, too, made confessional statement before the police.

However, co-accused Neeraj Kumar and some others, having more or less similar allegation, have already been granted

Patna High Court CR. MISC. No.86201 of 2019(3) dt.19-03-2020 2/2 privilege of bail by different Benches of this Court. Although, petitioner has criminal antecedent, but considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P. S. Case No.489 of 2018.
