Petitioner, who is in custody, seeks bail in connection with Rajiv Nagar P.S. Case No. 186 of 2018 registered for the offences punishable under Sections 420, 406 of the Indian Penal Code.

Informant in her written complaint addressed to the SHO, Rajiv Nagar alleged that petitioner has proposed for the marriage on a matrimonial site, namely, Shadi.com which has been accepted by the informant and thereafter on the pretext of marriage petitioner misappropriated $ 80,000/- (Rs. 50,00,000/-) for the purpose of investment of business but the said amount has not been returned which has been taken on the false

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner is a highly qualified person working in the U.S.A. and established a software development company in the name and style of Intelliber Technology Private Limited registered under the Company Act. Petitioner has never given any assurance of marriage to the informant although both knew each other through the same matrimonial site. Petitioner is seriously ill and blind with left eye and has sever problem in the right eye. As a matter of fact, the instant case is a civil dispute which has been given the colour of criminal case. Chargesheet has also been submitted and there is no chance of tampering with the evidence of this case. Petitioner is in custody since 01.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-III, Patna, in connection with Rajiv Nagar P.S. Case No.

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (S. Kumar, J) Rajiv/- U T
