The petitioner seeks anticipatory bail in connection with Jai Nagar P.S.Case No. 168 of 2015, registered for offences punishable under Sections 302 and 307/34 of the Indian Penal Code and Section 3/4 Explosive of Substance Act. As per F.I.R., allegation against the petitioner is that the informant woke up on the sound of explosion and the petitioner and other co-accused persons flee away from there and father of the informant succumbed to injury and his grand mother also received injury.

Submission of the learned counsel for the petitioner is that the impugned order itself shows that the final form has been submitted against the petitioner and ultimately, the

Patna High Court Cr.Misc. No.78494 of 2018(2) dt.09-01-2019 2/2 cognizance has been taken. It is further submitted that one of the co-accused has been granted the privilege of bail by a Coordinate Bench of this Court vide order dated 09.07.2018 passed in Cr. Misc. No. 39381 of 2018.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Jai Nagar P.S.Case No. 168 of 2015, to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
