This application for anticipatory bail arises out of Bahera P.S. Case No. 317 of 2015, disclosing offences under Sections 147, 148, 149, 341, 323, 384, 504, 506, 379, 452 and 380 of the Indian Penal Code.

Allegedly, these petitioners and other co-accused persons assaulted the informant with iron rod and danda. They are also said to have taken away certain utensils from the house of the informant. It has also been submitted that no injury has been shown though First Information Report was registered one month after the alleged date of occurrence. The petitioners have no criminal antecedent.

Patna High Court Cr.Misc. No.76910 of 2018(2) dt.11-01-2019 2/2 Considering the facts and circumstances of the case, this application is allowed.

Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in Bahera P.S. Case No. 317 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
