JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 31-01-2020 This writ application has been filed seeking direction to the respondents to relieve the petitioner from Nawada District Police Force so as to allow him to join in Banka District Police Force after his promotion from the rank of Sub Inspector of Police to the rank of Inspector of Police by virtue of an order issued vide memo No.521 dated 02.12.2012, by the Additional Director General of Police, Headquarters, Bihar. There appears to be not much dispute that after his promotion to the rank of Inspector, the petitioner was ordered to be posted under the district of Banka.

Patna High Court CWJC No.46 of 2020(4) dt.31-01-2020 2/2 Mr. Nadeem Seraj, learned Government Pleader No.5 appearing on behalf of the State of Bihar, has produced before this Court an order issued by the office of the Director General of Police, Bihar, dated 30.01.2020, whereby necessary direction has been issued for relieving the petitioner immediately for him to join as Inspector of Police at Banka. The office of the Director General of Police, Bihar, has further directed the Inspector General of Police, Magadh Range, Gaya, to explain the circumstance in which the petitioner was not relieved from Jehanabad District when he was promoted to the rank of Police Inspector, for joining in the district of Banka. In view of the said order dated 30.01.2020, the grievance of the petitioner has been substantially redressed.

The petitioner shall be at liberty to claim his seniority and other consequential benefits, which he would have been entitled to, had he been relieved from Jehanabad immediately after his promotion to the rank of Inspector of Police. With the aforesaid observation, this application stands disposed of.
