13-02-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Ram Krishna Nagar P.S. Case No. 590 of 2018 registered for the offence under Sections 420, 467, 468, 387 and 34 of the Indian Penal Code.

In the F.I.R., the informant has alleged that his father purchased a piece of land in the year 1988 and in the year 2015, when he tried to make construction over the said land, the accused persons came and stopped the work and claimed the land belongs to them and in this regard, they produced a photocopy of deed no. 3401/1986. It is further alleged that a case under Section 144 Cr.P.C. was initiated, in which, accused persons never participated and now, they are demanding Rs. 30 lacs or one flat in the apartment, being constructed, otherwise threatened for dire consequences.

Patna High Court CR. MISC. No.87037 of 2019(2) dt.13-02-2020 2/2 It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case and has committed no offence. It is further submitted that in fact, petitioner purchased the land from Pramod Kumar, in whose name mutation is running, and land possession certificate has been issued. Petitioner is having no criminal antecedent. Alleged dispute is of civil nature. No criminal offence is made out. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge XIII-cumAdditional Chief Judicial Magistrate, Patna in connection with Ram Krishna Nagar P.S. Case No. 590 of 2018 on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
